Agreement to Terms
By downloading, installing, or using SuperCards ("the Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Apps.
These Terms apply to:
- SuperCards for macOS (desktop application)
- SuperCards for iOS (mobile application)
- The SuperCards website at supercards.io
Beta Software Notice
SuperCards is currently in beta. This means the Apps are provided for testing and evaluation purposes.
As beta software:
- Features may change, be added, or be removed without notice
- Bugs and issues may exist
- Data loss is possible, though we work to prevent it
- The Apps are provided "as is" without warranty
We strongly recommend:
- Regularly exporting and backing up your data
- Keeping copies of important flashcard content outside the Apps
- Reporting bugs and issues to help us improve
Description of Service
SuperCards is a flashcard application that allows you to:
- Create and edit flashcard decks on macOS
- Study flashcards on iOS using gesture-based controls
- Export and import deck data between devices
SuperCards is currently a local-first application. Your data is stored on your device, not on our servers.
Your Account
SuperCards does not currently require user accounts. You can use the full functionality of the Apps without registering or providing personal information. Future versions may introduce optional accounts for features like cloud sync. These Terms will be updated accordingly.
Your Content
Ownership
You retain full ownership of all content you create in SuperCards, including:
- Flashcard text and formatting
- Images you upload or add to cards
- Deck organization and structure
- Any exported data files
We claim no ownership or intellectual property rights over your content.
Your Responsibilities
You are responsible for:
- The content you create (ensuring it doesn't violate laws or third-party rights)
- Backing up your data
- Maintaining the security of your devices
- Any images or materials you incorporate into your flashcards
Content Restrictions
You agree not to use SuperCards to create, store, or distribute content that:
- Infringes on intellectual property rights of others
- Is illegal, harmful, threatening, abusive, or harassing
- Contains malware or malicious code
- Violates any applicable laws or regulations
Since your content is stored locally and not transmitted to us, we do not monitor your content. However, violation of these restrictions may result in termination of your license to use the Apps.
License to Use
Grant of License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the Apps on devices you own or control
- Use the Apps for personal, non-commercial purposes
- Export your data for backup or transfer purposes
Restrictions
You may not:
- Copy, modify, or distribute the Apps
- Reverse engineer, decompile, or disassemble the Apps
- Remove or alter any proprietary notices or labels
- Use the Apps for commercial purposes without written permission
- Sublicense, sell, or transfer your license to others
- Use the Apps in violation of any applicable laws
Intellectual Property
Our Property
SuperCards, including its design, features, code, graphics, and documentation, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
Feedback
If you provide feedback, suggestions, or ideas about SuperCards:
- You grant us a non-exclusive, royalty-free, perpetual license to use that feedback
- We may implement suggestions without compensation or attribution
- You are not required to provide feedback
Third-Party Services
Apple Services
The iOS app is distributed through Apple's App Store and TestFlight. Your use of these services is subject to Apple's terms and conditions.
Third-Party Content
You may incorporate third-party content (such as images) into your flashcards. You are responsible for ensuring you have the right to use such content.
Disclaimers
"As Is" Provision
THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY.
No Guarantee
We do not guarantee that:
- The Apps will meet your specific requirements
- The Apps will be uninterrupted, timely, secure, or error-free
- Results from using the Apps will be accurate or reliable
- Any errors will be corrected
Beta Disclaimer
As beta software, SuperCards may contain bugs that could result in data loss or other issues. Use at your own risk and maintain backups of important data.
Limitation of Liability
Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR: INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, USE, OR GOODWILL; ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APPS; ANY DAMAGES ARISING FROM DATA LOSS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
Maximum Liability
Our total liability for any claims related to these Terms or the Apps shall not exceed the amount you paid for the Apps (currently $0, as the Apps are free).
Jurisdictional Limitations
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Apps
- Your violation of these Terms
- Your violation of any third-party rights
- Content you create or distribute using the Apps
Termination
By You
You may stop using the Apps at any time by:
- Uninstalling the Apps from your devices
- Deleting your local data
By Us
We may terminate or suspend your license to use the Apps:
- If you violate these Terms
- For any reason, with or without notice
- If we discontinue the Apps
Effect of Termination
Upon termination:
- Your license to use the Apps ends immediately
- You should export any data you wish to keep before uninstalling
- Provisions that should survive termination will remain in effect
Changes to Terms
We may modify these Terms at any time. Changes will be effective when posted on our website.
For significant changes, we will provide notice through:
- The website
- In-app notification (when possible)
- Email (if you've provided one)
Your continued use of the Apps after changes constitutes acceptance of the new Terms.
General Provisions
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or your use of the Apps will be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class actions.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Apps.
Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
Assignment
You may not assign your rights under these Terms. We may assign our rights without restriction.
